Service provider
Services are provided by Zinddin Boulourhmane Louza, trading as Webs del Camp, tax identification number (NIF) 79216950-M, at Carrer Joan Serra i Vilaró 7, 43007 Tarragona, Spain. Telephone: 611 715 657. Email for legal communications: drets@websdelcamp.cat.
Scope
Services include the design, development, improvement and maintenance of websites, software and custom digital tools, together with process integration and automation. Each accepted proposal specifies the scope, schedule, deliverables, review rounds, payment arrangements and specific terms. Any expressly agreed specific term takes precedence in a conflict, subject to applicable mandatory rights.
Entering into a contract
The calculator and form help prepare an enquiry. They do not in themselves place an order or create an obligation to pay. A contract is formed when both parties expressly accept a proposal or statement of work identifying the service and its price. Before accepting, clients can review and correct their details and ask for clarification.
Published prices
Each price applies to the stated scope and version. The current public offer identifies its packages and terms. Removing a catalogue does not change earlier agreements, which retain their accepted version and price. Published prices include VAT. Licences, domains, payment gateways and other external costs are listed separately when needed.
Packages and pricing
The standard price represents the package’s features and quantities purchased separately. The package price is calculated by combining the product’s components, counting shared work once and applying a 20 % adjustment to the combined price for the predefined scope. It is not a previous selling price or a temporary promotion. Selecting a package or sending an enquiry does not accept or purchase the service; a proposal must be expressly accepted to enter into a contract.
Scope and changes
The proposal identifies the product, its features and quantities, available tools, delivery conditions and agreed price. It may combine capabilities from different service families. Any change in scope requires prior acceptance of its quoted cost. Errors we make within the agreed scope are corrected without an extra charge. A new requirement, a change of direction or additional content may require an extension to the scope.
Client cooperation
Clients must provide the content, access, decisions and materials needed, with sufficient rights to those materials, and review milestones within agreed deadlines. Delays caused by missing materials, access or approval will reasonably shift the schedule without changing the price of work already commissioned.
Delivery, review and publication
The proposal details milestones and review rounds. Before publication, clients can check the work and report departures from the agreed scope. Publication requires the necessary access and relevant approval. Work is not deemed accepted while a specific issue reported during the review process remains outstanding.
Payments
Amounts, due dates and payment methods are stated before the contract is agreed. Additional work is not carried out or charged for without acceptance. In the event of non-payment, we may suspend work or recurring services after notifying the client, without affecting statutory consumer rights.
Ownership and licences
Once payment is complete, clients receive the deliverables and the rights of use or exploitation described in writing in the proposal. Where rights are assigned, the assignment will specify the rights, forms of use, territory and duration. Third-party components, fonts, plugins, platforms and resources remain subject to their own licences. Reusable internal tools that are not part of the deliverable are also excluded.
Third-party services
Domains, hosting, email, payment gateways, booking systems, analytics, plugins and other external platforms depend on their providers. We will state known costs and which accounts the client needs to arrange. We are not responsible for outages or changes made by third parties, but remain responsible for faulty configuration directly attributable to Webs del Camp.
Maintenance of existing websites
Recurring maintenance requires a technically compatible website in a condition that allows safe work. If we identify existing faults, malware, technical debt or insufficient access, we will explain the findings and any repairs needed before adding the website to the plan. Repairs will not be charged for without acceptance.
Duration and termination
Projects end with the agreed delivery. Recurring services follow the duration and cancellation arrangements stated in the proposal. If no minimum term has been agreed, they may be ended for the next billing period through an unequivocal notice. Termination does not remove amounts already due or obligations to return access or information.
Consumers’ right of withdrawal
Consumers entering into a distance contract generally have fourteen calendar days from its conclusion to withdraw. If a consumer expressly requests that work begin during that period and withdraws before the service is fully performed, they must pay the proportion already provided. The right ends once the service has been fully performed, provided the start of work and loss of the right have been expressly accepted in accordance with the law.
Guarantees and liability
We are responsible for delivering work that conforms to the agreed scope and for obligations that cannot be excluded by law. Liability for damages requires a direct link to a breach attributable to Webs del Camp. No clause limits mandatory rights, liability for intentionally caused harm or liability that cannot lawfully be excluded.
Governing law and disputes
Spanish law applies. We will try to resolve issues directly. Consumers may bring proceedings before the courts competent under consumer law. In dealings between businesses or professionals, where valid, the parties submit to the courts of Tarragona.
